So… if a kickoff goes out of bounds but it does so past the end zone, it’s still a penalty right??

Is it a penalty if the receiving team waves a fair catch.

Are there any exceptions to the ball on the 40 if the kickoff goes out of bounds?

If someone on the receiving team touches it and it goes out of bounds that could be an exception.

No, not a penalty. If the ball goes into the endzone before it goes out of bounds it is a touchback, ball gets placed a the 25-yard line.

In this case it never touched the end zone. It just got kicked that deep but landed out of bounds first. Does that change anything?

No…it broke the plane of the endzone before it went out of bounds. Kind of like how it’s a TD if a runner dives for the endzone right by the pylon and he lands out of bounds. As long as the kickoff breaks the plane before going out of bounds it’s a touchback.
